Which rules can apply to Virgin Atlantic flights
Virgin Atlantic is registered here as a UK carrier.
- UK261 can apply when this UK carrier departs the UK, arrives in the UK from abroad, or arrives in the EU from abroad.
- EU261 can apply to its flights that depart from an airport in an EU member state (plus Iceland, Norway and Switzerland), whichever airline operates them.
- Whether a given flight is covered still depends on the operating carrier, the airports, the delay at final arrival and the stated cause.
This is orientation from the carrier's registration, not advice on a specific flight. Use the calculator for a preliminary check.

Virgin Atlantic: how to prepare your claim
A Virgin Atlantic ticket can include a Delta or other partner-operated flight. Start with the operator of the disrupted sector, then use Virgin's disruption-compensation channel when Virgin operated it. The ticket seller and the airline responsible for the flight can be different.
Submit a disruption claim, not a fare-refund request
Enter through Virgin's Help centre and select disruption and compensation. Prepare the Virgin booking reference, passenger details, affected flight and a short account of the final arrival. Keep expense receipts in a separate subtotal. A request to refund an unused ticket follows the refund process; an already completed late journey needs an assessment of disruption rights instead.
London departure versus a US connection
Consider London Heathrow–New York–another US city on one reservation. Record the last ticketed destination and whether the onward flight was Delta-operated. Virgin is UK-licensed, so a Virgin-operated US-to-UK flight differs from a standalone Delta-operated return. Do not treat a joint booking, a frequent-flyer partnership or a VS marketing code as proof that every sector has the same operator or legal scope.
The published 28 days is a response window
Virgin's carriage terms ask passengers to claim directly and allow 28 days for a response before engaging a representative. That is not a verified average or a promise to pay in 28 days. If the reply attributes the disruption to US weather, request the flight-specific cause and its effect on the journey. Where a partner rerouted you, retain the replacement boarding passes so the assessment uses the arrival you actually experienced.
